Who May Not Get a Permit to Carry
According to Virginia Code Section 18.2-308.09, you will be disqualified from getting a Virginia concealed handgun permit if you:
- Are ineligible to possess or transport a firearm under Virginia or federal laws.
- Are subject to a restraining order, or to a protective order and prohibited from purchasing, possessing, or transporting a firearm under Virginia laws.
- Have been convicted of two or more misdemeanors (excluding traffic infractions) within the five years prior to submitting your application.
- Are addicted to, or an unlawful user or distributor of, marijuana, synthetic cannabinoids, or any controlled substance.
- Have been convicted of driving while intoxicated under state or local law, of public drunkenness, or of a substantially similar offense under the laws of another state, the District of Columbia, the United States, or any U.S. territory within the three years prior to submitting your application.
- Are a habitual drunkard according to Virginia law.
- Are an alien who is not lawfully admitted for permanent residence in the United States.
- Have been dishonorably discharged from any branch of the U.S. Armed Forces.
- Are a fugitive from justice.
- Have been found by a court to be likely to use a weapon unlawfully or negligently to endanger others.
- Have been convicted of any assault, assault and battery, sexual battery, or discharging or brandishing a firearm in violation of Virginia laws within the three years prior to submitting your application.
- Have been convicted of stalking.
- Have previous convictions as a juvenile that would have been a felony if you were an adult at the time of your conviction.
- Have a pending charge for a felony.
- Have received mental health or substance abuse treatment in a residential setting within the five years prior to submitting your application.
- Have been found guilty in any state, the District of Columbia, or any U.S. territory of a criminal offense related to the illegal possession or distribution of marijuana, synthetic cannabinoids, or any controlled substance within the three years prior to submitting your application.
