Penal Code Chapter 46: Important Definitions

Here are important definitions for you to know as you study the laws from Texas Penal Code Chapter 46.

• Handgun: Under Penal Code §46.01(5), any firearm that is designed, made, or adapted to be fired with one hand
• Institution of Higher Education and Private or Independent Institution of Higher Education: Under Penal Code §46.03(c)(2), any institution as defined in §61.003 of the Texas Education Code
• Premises: Under Penal Code §46.03(c)(4), a building or portion of a building; does not include any public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area
