Penal Code §9.22: Necessity

According to Penal Code §9.22, necessity is a situation where your conduct is justified if:

• You reasonably believe it is immediately necessary to avoid imminent harm and…
• The desirability and urgency of avoiding the harm clearly outweigh, according to ordinary standards of reasonableness, the harm that will be caused by the use of deadly force and…
• A legislative purpose to exclude the justification claimed for the conduct does not otherwise plainly appear.
