Course Outline

Texas Penal Code §46.03 applies to both license and non-license holders. It lists the specific places where handguns are prohibited.

  • Under §46.03, you are prohibited from carrying a handgun:
    • On the physical premises of a school or educational institution, any grounds or building on which an activity sponsored by a school or educational institution is being conducted, or a passenger transportation vehicle of a school or educational institution (unless you have written authorization from the institution, or you have an LTC and a concealed handgun and the institution is a college or university) or…
    • On the premises of a polling place on the day of an election or while early voting is in progress or…
    • On the premises of any government court or offices utilized by the court (unless you have written authorization from the court) or…
    • On the premises of a horse or greyhound racetrack where pari-mutuel betting is allowed or…
    • In or into a secured area of an airport or…
    • Within 1,000 feet of premises designated as a place of execution on a day that a sentence of death is set to be imposed.
  • It is important to note that under §46.03(f), it is not a defense to prosecution if you possess a handgun while in one of these prohibited locations even if you have a valid LTC.
